Trial moved for Bismarck man accused of murdering his 12-week-old daughter

BIMSARCK, N.D. - The Bismarck man accused of murdering a three-month-old will have his day in court next year.

Twenty-two-year-old Jose Rivera-Rieffel is charged with murder, child abuse, and disobedience of a judicial order.

Detectives say Rivera-Rieffel was taking care of his children on April 18 of last year and the next day the child had life threatening injuries to the head. On April 27, the baby died because of the injuries, according to the affidavit.

Police say the injuries didn’t look accidental.

The forensic report shows the cause of death was delayed consequence of blunt force trauma to the head.

Rivera denied being in the apartment the day of the baby’s assault. Police say he later changed his story and said he was in the apartment but the children weren’t with him. Records show he eventually admitted to watching them but refused to talk about how the baby received the injuries.

His trial in two weeks was rescheduled because an attorney wasn’t available.

Rivera’s case will be heard next year during an eight-day trial beginning on February 5.
