Jury delivers not guilty verdict in Morton County attempted murder case

MANDAN, N.D. - After less than an hour of deliberation, a jury found 17-year-old Dequan Smith not guilty of attempted murder Friday.

A Morton County jury found Smith not guilty of attempted murder, reckless endangerment and two counts of aggravated assault.

The jury did find Smith guilty of intent to distribute an imitation controlled substance.

Smith was sentenced to two years probation.

When asked by Judge Pamela Nesvig his plans for the future, Smith said his intentions are to move to Minnesota with his aunt and finish his GED.

Smith was accused of shooting a 27-year-old woman on December 30,2018.

Smith’s attorney argued there was a second man involved in the shooting that was never identified.

State’s attorney Gabrielle Goter says she is disappointed with the verdict. She added, Mandan is the community she resides in, and the not guilty verdict doesn’t reflect the work done in the case.
