Guardian Flight sues ND insurance commissioner, attorney general for service charges

BISMARCK, N.D. - North Dakota's Insurance Commissioner Jon Godfread and Attorney General Wayne Stenehjem are being sued in their official capacity by air ambulance provider Guardian Flight.

Court documents filed by Guardian Flight claim that when the state passed a bill in 2017 to regulate the amount air ambulance services charge it was going against the federal airline reregulation act.

"We've got to find a better solution to that and we believe the bill we passed does that and it fits within the rules of what we can do given we are regulating the business of insurance," said Godfread.

The federal act says that states cannot limit how much air ambulance services charge.
