DIVIDE COUNTY, N.D. - A woman is in jail after a fatal accident Saturday afternoon.

The Divide County Sheriff's Department says 27-year-old Kayla Marie Kain was driving a pick-up truck with a male passenger riding on the tailgate, when she sped over railroad tracks.

The man was ejected from the truck, and the report says he was killed instantly.

The Sheriff's Department says Kain admitted to law enforcement she had been drinking, and authorities say she failed a field sobriety test.

She faces charges of negligent homicide and criminal vehicular homicide.
