BISMARCK, N.D. - UPDATE: A judge has ordered a $250,000 cash bond for Curtis McGarvey. The judge also ordered no contact, no social media and no internet access if he does bond out.
More details on what exactly McGarvey is accused of have been released via court documents.
According to the affidavit, McGarvey sent a “.gif,” a moving picture, of a female who appeared to be less than 18-years-old giving oral sex to a male. This message was sent to 20 different people including the mother of one of the victims.
Court documents also link McGarvey to a bomb threat made at Bismarck High School during a senior banquet on May 3.
Records say he told the officer on the case that “his failure to act could risk 200 kids’ lives.”
The affidavit says the mother of one of the victims received a message warning her to keep her daughter away from the other victim. Threatening her daughter by saying he was going to upload a photo of her on “every site I can if she continues to see him.”
The Burleigh County state’s attorney’s office requested a $500,000 cash bond and McGarvey’s attorney requested a $5,000 bond instead.
UPDATE 12:45 PM: Curtis McGarvey has been charged with 20 counts of promoting a sexual performance by a minor, child neglect and terrorizing. He will have his initial appearance Monday afternoon.
ORIGINAL STORY: A Bismarck man has been arrested for promoting a sexual performance by a minor.
Police say in June of 2016 a juvenile female victim reported that she believed someone had accessed her cell phone and deleted some messages.
They have also been investigating on-going reports of vandalism, terrorizing, harassment and theft.
On May 8th police executed eight search warrants and seized multiple pieces of evidence from 50-year-old Curtis McGarvey .
McGarvey is being held at the Burleigh-Morton Detention Center until formal charges are filed.
