Bill would mandate Breathalyzer sales for retail alcohol licensee

BISMACK, N.D. - Fargo senator Kathy Hogan wants to make North Dakota bars sell breathalyzers along with alcohol.

Hogan's bill SB 2206 would mandate any retail alcohol licensee must sell FDA approved breathalyzers.

Not doing so would be a class B misdemeanor,, with a max penalty of 30 days in jail and a $1,500 fine.

Hogan says some bars are supporting the move.

"They've said I can do a $100 investment and if I save a life just in terms of supply, they think that would be a good thing to do."


A senate subcommittee will hear testimony on the bill on January 16 at 9 AM.
