UPDATE: Man still in critical condition after being shot in chest at downtown Fargo apartment

FARGO, N.D. (Valley News Live) - A man is still in the fight for his life at a local hospital after being shot in the chest at close range Friday night in downtown Fargo.

Hours after the incident, 24-year-old Schuyler Ferguson turned himself into police. He’s now been charged in court with attempted murder, aggravated assault and terrorizing.

Officers were called to the the apartment units above Rhombus Guys in the 600 block of Main Ave. around 9:30 p.m. on Friday, Sept. 30. Court documents say Ferguson came over the apartment with three others to play video games and had a gold colored pistol. Witnesses told police they all believed the gun was a BB gun.

Documents say Ferguson was shooting the gun at people in the apartment without any ammo inside, also known as dry firing. Ferguson then pointed the gun toward the victim and dry fired. Witnesses say the victim became upset and punched Ferguson in the neck. Documents say Ferguson then stepped back, loaded a magazine into the gun fired one round to the victim’s chest.

Ferguson will be seen again in court on Nov. 9.
