Suspect accused of shooting Bismarck man changes plea to guilty

BISMARCK, N.D. (KFYR) - A Bismarck man accused of shooting and killing a man at Misty Waters gas station has pleaded guilty.

On Wednesday, 29-year-old Diego Ashton pleaded guilty to murder.

Ashton is accused of shooting 47-year-old Robert Becker in October of 2020.

According to the affidavit, Ashton was a passenger in Becker’s vehicle when it stopped at Misty Waters gas station. Ashton explained to investigators that Becker laughed at him, and Ashton said he had had enough. Ashton shot Becker, pulled him out of the vehicle, and left the scene before turning himself in.

A presentencing investigation has been ordered, which typically takes six to eight weeks.

Ashton will be sentenced after the presentencing investigation concludes.
