Same-Sex Couples File Lawsuit

Nineteen states and the District of Columbia have ruled same-sex marriage bans unconstitutional. And now, North Dakota is joining the conversation.

Seven couples filed a federal lawsuit challenging the state's ban on same-sex marriage and it's refusal to recognize the marriages of same-sex couples who wed in other states.

The Minneapolis attorney representing the couples also filed a lawsuit on behalf of a group of South Dakota couples in May.

"So, collectively, these nineteen states and the District of Columbia have marriage equality. And these other 31 states with the inclusion of North Dakota are on that same path. And that's the purpose of this lawsuit. It's to help North Dakota along to help join that national discussion and to make sure the same sex couples in loving and committed relationships in the state are seen as equals just like they should be every where else in the United States," says associate attorney Joshua Newville, Madia Law, LLC.

"I think it's a great day in North Dakota, because now we're officially a part of the conversation that's happened in other states throughout the nation," says Rep. Joshua Boschee.

The North Dakota Family Alliance plans to defend the state's constitutional marriage provision. Executive Director Tom Freier says it has been proven over centuries to be in the best interest of families and society that marriage is between a man and a woman.

"We are most definitely going to defend North Dakota's constitution, the measure that was passed in 2004 by a vote of 73 percent of the people. We're going to defend that as best we can," says Freier.

Attorney General Wayne Stenehjem says he has not been served with the Complaint in the lawsuit and he can't comment on the specifics of the case. But he says it is the constitutional duty of the Attorney General to represent the state when it is sued and only the Supreme Court can determine whether North Dakota's enactment is constitutional or not.
