Prosecution Seeks Life For Michael Spell

One of the men accused of killing a Sidney, Mont. teacher is no longer facing the possibility of the death penalty.

In a scheduling conference today, the prosecution decided to only seek life in prison for Michael Spell if he's convicted, saying he is intellectually disabled.

He and Lester Waters Jr. are charged with kidnapping and killing Sherry Arnold in January of 2012.

Waters already accepted a plea agreement to testify against Spell in order to avoid the death penalty himself.

Spell's trial is scheduled for November 17 in Glendive, Mont.
