Judge Rules in Favor of Public Service Commission

A U.S. District Judge has ruled in favor of the North Dakota Public Service Commission, which was the subject of a lawsuit brought by the Sierra Club and Dakota Resource Council.

It concerned the acceptance of campaign contributions given to members of the PSC by individuals and groups associated with coal mining interests, which the PSC regulates.

Judge Daniel Hovland noted that the Commissioners' acceptance of the campaign contributions was not unlawful under State or federal law, although he added that the decision to do so is "ill-advised, devoid of common sense, and raises legitimate questions."
