Public Service Commission Appears in Federal Court

Posted: Updated:

A federal judge heard accusations this morning that members of the Public Service Commission took illegal campaign contributions.

The Sierra Club and Dakota Resource Council claim Commissioner Brian Kalk and former commissioners Kevin Cramer and Tony Clark took more than $50,000  from individuals with connections to coal companies. They say no one should receive money from companies they regulate.

Lawyers for the commissioners say any contributions they received were completely legal.

"There's just a real concern that if the coal companies, through the owner and his wife and the officers, are giving campaign contributions to the Public Service Commissioners, that might be undue influence," says Wayde Schafer.

Kalk says he was happy with how the hearing went and says he trusts  District Judge Daniel Hovland's opinion. Hovland says he hopes to make a ruling within the next month.
