Heitkamp Comments on Supreme Court Decisions

The Supreme Court issued two key rulings affecting same-sex marriage today, and the rulings are being hailed by some as a historic victory.

The divided Supreme Court struck down a key provision of the Defense of Marriage Act, ruling that legally married same-sex spouses may receive federal benefits. The vote was 5-4.

The Supreme Court also dismissed an appeals case on California's same-sex marriage ban, Proposition 8. The justices held that traditional marriage activists who put the proposition on California ballots did not have the constitutional authority or standing to defend the law in federal courts after the state refused to appeal its loss at trial. The appeals court's stay on the decision will be lifted, and the lower court decision allowing for same-sex marriage will be reinstated.

Senator Heidi Heitkamp says the decisions are a triumph for equality.

"As the tide continues to shift across the country, these decisions not only reflect the changing mood of the country, they also were based on sound legal reasoning," says Senator Heitkamp. "Discrimination is discrimination and our government has no business treating the relationships of same-sex couples any different than it treats the relationship I have with my husband."
