N.D. Attorney General launches investigation into Spa D' Athena

BISMARCK, N.D. - According to the North Dakota Attorney General's website, the consumer protection division has initiated an investigation into Spa D’ Athena in Bismarck.

Recently the spa said on Facebook it will be renovating, remodeling and reopening at a later date.

As of Tuesday evening, the spa had a Facebook post about refunding gift cards on its website, which said it was closing Oct. 27 and it had no set date to reopen.

Investigators have been in contact with the business on the ability to make those refunds.

North Dakota Attorney General Wayne Stenehjem said in a statement on his website that he is concerned about attempts by Spa D’Athena to limit the claims process, including any implication that consumers may be waiving certain rights they have if they respond to or send an email to the company.

Customers are upset that gift cards to the spa won't be reimbursed, but a few local businesses in Bismarck are helping people put these gift cards to use.

Electric Sunn Tanning and Salon in Bismarck is offering people 50 percent off of their gift cards for select stylists and massage therapists.
While the Rejuvenation Place is letting people trade in a gift card for a $100 gift card for certain services.

"In our community, it's so small that people talk and people know each other. I would love to bring some people in for our new girls and also for the existing girls that are here that we've got a lot to offer," said Kim Schuh, owner of Electric Sunn Tanning and Salon.

The investigation is in its preliminary stage, but Stenehjem is encouraging everyone who currently has gift cards to file a consumer complaint to his office so they can track the value of the unredeemed gift cards.​
