Deputy U.S. Marshal found guilty of recording women in fitting rooms files appeal

BISMARCK, N.D. - The Deputy U.S. Marshal found guilty of recording video of women in fitting rooms was sentenced by a district court to three years in prison back in June.

Thirty-year-old Michael Rivera is appealing his sentence to the Supreme Court. His attorney Lloyd Suhr is arguing that three Class A misdemeanors that are similar in nature cannot be stacked to form three consecutive one year sentences.

We have reached out to the state's attorney's office for comment and have not heard back.
