Borner and Whitman Take The Stand

Both men testified they brought loaded weapons into the home, but did not intend to use them.
"We were going to steel some weed, possibly money. That was it," Borner said.
"I didn`t know for sure if Mike was going to be there or not. I was hoping not because when I talked to Shirley I didn`t hear him in the background and usually I do. But if he was I didn`t want to run into a fight or nothing like that. I honestly believe nobody in their right mind would start anything with somebody who had a gun," Whitman said.
According to testimony, Michael Padilla did approach both men and tried to take the weapons away from them.
Both the prosecution and defense attorneys acted out the scenario that occurred in the Padilla home, where two men were shot and one of them died.
Borner testified that after the shooting, they both fled and drove back to Hazen.
"I was a little freaked out. I was just kind of asking what the hell happened in there. And do you recall Rick saying anything to you? He said I don`t know (expletive) went bad. You have to forgive me for this. I`m sorry."
Following their testimonies, both sides presented closing arguments.
Both Borner and Whitman are charged with two counts of conspiracy to commit murder, the lesser included of conspiracy to commit reckless endangerment.
