ND Supreme Court Revives Lawsuit Against Township

North Dakota`s Supreme Court has revived a lawsuit against a Dickey County township for an ATV accident that killed a 13-year-old boy.

A judge earlier dismissed the lawsuit against Albion township in southeastern North Dakota.

The Supreme Court`s ruling says there`s a question about whether township board members knew about a potentially dangerous washout trench along part of the section line.

The court says if the township board knew about the washout, it was obliged to post warnings about it.

The lawsuit was filed by the parents of 13-year-old Brason Kappenman of rural Ellendale.

The boy was killed in August 2006, when he drove an ATV into the washout. Authorities said at the time the hazard was difficult to see.
