A Bismarck state lawmaker is accused of assaulting his wife over the weekend. Police say Representative Dave Weiler is charged with misdemeanor simple assault.
He`s accused of pushing his wife Nicole to the ground at least twice late Friday night in the driveway of the couple`s home.
Bismarck Police Lt. Randy Ziegler says Nicole Weiler struck her head and suffered a bruised left cheekbone, a bruised right bicep, a scrape on her right hand and a gash on her right ankle.
She was treated at a Bismarck hospital and released.
The police report says officers who responded to the call said they were worried Nicole Weiler had suffered a concussion.
Dave Weiler, 43, represents south Bismarck, the city of Lincoln and some adjacent areas of Burleigh County. The Republican was first elected to the House in 2000.
He was booked into the Burleigh County jail and spent eight hours there before he was released just before 10 a.m. Saturday.
Weiler calls the incident an unfortunate private matter and says he and his wife are working things out.
Weiler says he and his wife are hoping the charge is dropped. Dave Weiler declined further comment.
The charge is in Bismarck municipal court. It carries a maximum punishment of 30 days in jail and a $1,000 fine.
City offices were closed Monday and the city attorney could not immediately be reached for comment.
Ziegler says the Weilers began arguing in the parking lot of a convenience store on Bismarck`s north side. He says they were in separate vehicles and continued their argument when they arrived home on Bismarck`s south side. |
