Public Records Decision

North Dakota public records can`t be hidden by putting them in private computers or e-mail accounts.

Attorney General Wayne Stenehjem has issued a legal opinion that deals with the issue. It was in response to a request from Bismarck attorney Chad Nodland.

Nodland wanted e-mail messages between former Workforce Safety and Insurance internal auditor Kay Grinsteinner and former board member Evan Mandigo.

Nodland asked for office e-mails during October 2007. He was told they didn`t exist, and so he asked for e-mails that were on private accounts. He was told they were not public records.

Stenehjem says if the e-mails exist, they`re public records and Nodland should get copies of them.

Stenehjem says if public business is being done on privately owned computers and e-mail accounts, those messages are public records.
